The bail review scheduled for Derreck Ophiem Thursday was cancelled after he hired private attorney Doug Hyldahl in lieu of public defender Sharon Aizer.


Opheim and Sean Heien were arrested on campus Oct. 21 and 22, respectively, on suspicion of armed robbery in the first degree and the trafficking of stolen property.


When an individual switches attorneys the incoming attorney must file a notice of appearance, Aizer said.


Ophiem remains in the Whatcom County Jail with a $100,000 bail and a status conference scheduled for Nov.  24.


Heien was released from the jail Oct. 23 when his $50,000 bail was paid.


The court ordered Heien not to leave Whatcom or King County overnight without prior court permission and that he is not to possess firearms or weapons.


Both defendants are scheduled to appear for trial in court on Dec. 7.


The trial is likely to be pushed back as late as January because such a serious case has more elements and complexities, which can require a long time to address, said Whatcom County Jail Chief Wendy Jones.
